These Terms and Conditions ("Terms") govern your use of the website theh2oheroes.com, the customer portal at refer.theh2oheroes.com, and The H2O Heroes Customer Portal mobile application (together, the "Services"), operated by Water Filter Warehouse LLC, doing business as The H2O Heroes ("we," "us," or "our"). By using the Services, you agree to these Terms.

1. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to interfere with or disrupt the Services, attempt to access accounts or data that are not yours, or use the Services to send spam or unlawful content.

2. Customer Portal Accounts

Portal access is provided to customers of The H2O Heroes. Sign in uses a one time code sent to the email address or phone number on file. You are responsible for keeping your email and phone number up to date and for all activity that occurs under your session. Notify us promptly if you believe your account has been accessed without authorization.

3. Products, Services, and Estimates

Information on the Services about products, installations, warranties, and pricing is provided for general information. Final pricing, scope, and warranty terms for any installation or service are stated in your written estimate, proposal, or service agreement, which controls over any general statement on the Services.

4. Appointments and Service Requests

Service requests submitted through the Services are requests only and are not confirmed until we contact you to schedule. We will make reasonable efforts to honor scheduled appointment windows.

5. Referral Program

Referral rewards are subject to the program terms in effect at the time of the referral, are available to eligible customers only, and may be modified or discontinued at any time. A referral must be a genuine referral of a person who has consented to be contacted.

6. Intellectual Property

The Services and their content, including logos, characters, graphics, text, and software, are owned by Water Filter Warehouse LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties regarding the Services themselves, whether express or implied, including merchantability, fitness for a particular purpose, and non infringement. Water quality information, boil water advisories, and similar alerts shown in the Services are informational only and may not be complete or current; always follow official guidance from your utility or health authority. Nothing in these Terms limits or changes the written warranty that accompanies your installed equipment.

8. Limitation of Liability

To the fullest extent permitted by law, Water Filter Warehouse LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability arising out of the Services will not exceed one hundred US dollars. This section does not limit liability that cannot be limited under applicable law and does not apply to your separate service or warranty agreements.

9. Communications

By providing your contact information you consent to receive service related emails, calls, and text messages from us. Marketing messages are optional and you may opt out at any time. See our Privacy Policy for details.

10. Termination

We may suspend or terminate access to the Services for violation of these Terms or misuse of the Services. You may stop using the Services at any time and may request account deletion as described in the Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Venue for any dispute relating to the Services lies in the state or federal courts located in Hillsborough County, Florida.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Services after changes take effect constitutes acceptance.
